The International Disciplinary Court, convened on October 13 at the FIM headquarters in Mies, Switzerland, in a public hearing in order to judge the appeal lodged by the Spanish Federation (RFME) against the decision taken by the International Jury in Kielce, Poland, during the International Six Days‰Ûª Enduro last September, to disqualify
the rider Arnau Vilanova, and to judge the request of the President of the International Jury to impose further
sanctions following the incidents during the sixth day of competition and the violent attitude of members of
the Spanish team.
Members of the Spanish team had taken offence to riders who wanted to ride the final stage after a rider boycott was organised due to the conditions.
The CDI decided to change the decision of the International Jury. The disqualification of the rider Arnau
Vilanova is confirmed. The whole Spanish team remains disqualified from the ISDE results and suspended for a
period of one year as from the date of the decision. The Spanish team is also sanctioned with a fine of CHF
10‰Ûª000, and must bear all the costs of the procedure. An appeal may be lodged against this decision to the
TIA within 5 days following the notification.
The International Disciplinary Court also judged the appeals lodged by the British and American Federations
(ACU and AMA) against the decision taken by the International Jury in Kielce, Poland, not to award medals
to the riders of the classes E2 and E3, who did not complete the Motocross test on the sixth day, and
therefore were considered as having not completed the Six Days, condition imposed for awarding the
medals.
The CDI decided to quash the decision of the International Jury. The riders in the classes E2 and E3, who
did not take part in the final Motocross test (which may be in this case considered as a case of indirect force
majeure), shall be awarded the Individual riders‰Ûª medals, to the extent that the riders concerned were not
disqualified.
The riders are to be included in the final classification of the 2004 ISDE. Half of the costs of the
procedure are to be borne by the appellant. An appeal may be lodged against this decision to the TIA within
5 days following the notification.
