Blake Parker has officially been crowned the 2010 NSW Motocross 9-U12yrs 85cc Champion, with Dylan Dukes and Reece Rayner taking second and third place respectively after court action was recently resolved.
A legal situation arose after the points leader after all rounds were completed was stripped of the title after a fuel test failed to comply with regulations.
As a result the rider in question through his family took Motorcycling New South Wales to the Supreme Court in an effort to have the ruling overturned. The court decided that the fuel sample was in breach of the rules of the sport but the no malice had been displayed. It was ruled that the MSNW's ruling should stand and as a result the title has been awarded to Blake Parker.
In a statement issued by Motorcycling NSW, MNSW General Manager, Daniel Gatt, said, "I would sincerely like to congratulate all three riders on their efforts during the 2010 series. It's unfortunate the rightful place-getters in Blake, Dylan and Reece could not be recognized for their efforts at the 2010 Night of Champions in front of their friends and families. In saying that, and despite the delay, we feel the final outcome has vindicated the process."
The statement added, Having now reached an outcome through the legal system, Motorcycling NSW feels It's unfortunate it had to spend considerable amounts of money and time defending its position. However, MNSW takes the stance that the outcome, and the result served for the breach, justified the expense, time and effort upholding the rules of the sport.
"Motorcycling NSW will continue to vigorously enforce the rules of our sport, to ensure fairness to all competitors in every discipline. With that being said, we now put this matter behind us and look forward to the fast-approaching 2011 motocross series," added Gatt.
In a closing statement MNSW stated, "MNSW believes performances should be highlighted and won on the track and encourages safe and fair competition from all competitors."
The 2011 NSW MX Championship which kicks-off on April 23 at the Lower Mountains Motorcycle Club, Lithgow.
