Global Action Sports (GAS) have responded to the media release sent out by Dainty Consolidated Entertainment over the Crusty Demons Thirst 4 Destruction Tour.
GAS claim the media release sent by Dainty Consolidated Entertainment yesterday to be incorrect and misleading.
In their own release GAS said, "Paul Dainty says that our action in the Supreme Court of NSW failed once he responded to the allegations. This is a blatant misrepresentation of the court orders made on the 19th.
"Contrary to what was said in the Dainty media release, the main purpose of our action against them was an injunction to prevent them from publishing misleading advertisements about the rider line-up. These orders remain in force.
"Our ‘attack’ as Dainty put it was not ‘stopped in its tracks’ – instead the primary injunction that we sought remains in full force.
"Dainty is also quoted as saying that the order obtained by us had been ‘set aside’. That is not correct. Dainty simply agreed yesterday that the ban on ticket sales be lifted on condition that the orders preventing him from publishing misleading advertisements remain in place. There was no contested hearing and the court did not make any findings in favour of Dainty.
"Further, the Dainty release once again refers to ‘the greatest rider line-up ever seen in this country.’
"Given that they don’t have contracts with Nate Adams, Adam Jones, Blake Williams, Cam Sinclair and Robbie Maddison, who have all ridden on Global Action Sports tours of Australia before, this statement is blatantly misleading.
"GAS have once again demanded that misleading statements be removed from Dainty advertising and have threatened further potential legal action, if they are not.
GAS CEO Michael Porra said ‘I’m just so disappointed that these people continue to mislead the Australian public. The release sent yesterday was designed to deceive people into believing that they had won a court case which was never heard and that the court orders were set aside, which they were not!’
"Finally, the Dainty release ignores the fact that a legal dispute is currently under way in the USA in relation to the Crusty Demons rights. Fans looking at buying tickets should be acutely aware that if Dainty and Fleshwound are unsuccessful in these proceedings, there will be no Crusty Demons Thirst for Destruction Tour at all!," the statement concluded.
